Vorläufige Genehmigung zur Rodung:
Die Firma Tesla hatte am 13.02.2020 eine Genehmigung des Umweltamtes des Landes Brandenburg zur vorzeitigen Rodung abholzreifer Kiefern auf einer Nutzholzplantage im nördlichen Industriegebiet Freienbrink erhalten. Diese Arbeiten fänden laut Umweltamt jedoch auf eigenes Risiko von Tesla statt, da eine endgültige Genehmigung noch nicht vorliegt.Tesla hatte im Rahmen des Verfahren unter anderem die dreifache Aufforstung mit Qualitätswald angekündigt. Sollte das Vorhaben Tesla in Freienbrink nicht genehmigt werden, müsse der Investor in Freienbrink wieder aufforsten, ist in einem Bericht des rbb vom 14.02.2020 beschrieben.
Die Rodungen begannen sodann am 13.02.2020 mittels Großgeräten wie Harvestern auf der Kiefern-Plantage.
Geschuldet ist die Eile, dem Beginn der Vegetationsperiode am 1. März. Sodann ist ein Fällen bis in den Herbst hinein nicht möglich. Bis dahin nicht gefällte Kiefern stünden den Baumaßnahmen im Weg. Der Vorhabenträger Tesla hatte das Verfahren am 19.12.2019 in Gang gesetzt.
Beschwerdeführer scheiterten
Gegen die Erteilung der vorzeitigen Rodungsgenehmigung durch das Umweltamtes des Landes Brandenburg ging einen Tag später ein bayerischer Verein (VLAB) sowie die Grüne Liga vor. Deren Beschwerden mit Ziel der Untersagung von vorzeitigen Rodungen scheiterten jedoch am 14.02.2020 vor dem Verwaltungsgericht Frankfurt/Oder.
Vorläufige Entscheidung des OVG Berlin-Brandenburg
Die Grüne Liga ging sodann zum Oberverwaltungsgericht Berlin-Brandenburg (OVG). Dort entschied man am 15.02.2020 vorläufig, dass die Rodungen einzustellen seien. Es müsse jedoch noch in der Sache geprüft und über die Beschwerde entschieden werden (Aktenzeichen OVG 11 S 8.20).
Die Grüne Liga vertritt der Rechtsanwalt Dirk Teßmer aus Frankfurt am Main. Es wird angegeben, dass durch die vorzeitige Rodung die gesetzlichen Voraussetzungen zur Freigabe nicht erfüllt seien. Dazu fehlten noch Stellungnahme der Fachbehörden und Umweltverbände sowie Berücksichtigung von Einwendungen aus der gerade abgeschlossenen Auslegungsphase der Planungsunterlagen
Wie geht es weiter?
Das Gericht muss noch entscheiden. Dazu wurde das Umweltamt des Landes Brandenburg bis Dienstag 18.02.2020 um Stellungnahme gebeten.
Sofern die Genehmigungsbehörde eine belastbare Prognose zur Genehmigung des Tesla-Werkes geben könne, ist die vorläufige Entscheidung des OVG Berlin hinfällig.
Die Stellungnahmen der Fachbehörden und Umweltverbände sowie Berücksichtigung von Einwendungen sind bis 5. März 2020 vorliegend, die Erörterung der Einwendungen findet am 18. März 2020 statt.
Florian Engels, Regierungsprecher der Brandenburger Landesregierung zeigte sich am Sonntag Mittag entspannt. In einem Post teilte er am 16.02.2020 mit, dass die Landesregierung unaufgeregt die Entscheidung des OVG abwarte und auf schnelle Entscheidung setze. Das Umweltamt werde selbstverständlich eine Stellungnahme bis Dienstag an das OVG senden.
Wer sind die Beschwerdeführer?
Der gemeinnützige Verein VLAB (Verein für Landschaftspflege & Artenschutz in Bayern e.V.) wird in der Öffentlichkeit kritisch gesehen, da ihm unterstellt wird, der menschengemachten Klimaerwärmung zu widersprechen. So geht der Verein aus Bayern u.a. gegen Windkraftanlagen und Natureingriffe im In- und Ausland vor.
Der Umweltverein Grüne Liga ist nach eigenen Angaben ein Netzwerk ökologischer Bewegungen. Sie sieht sich als Kind der Wendezeit 1989 in der DDR.
Die Grüne Liga gab nun gegenüber dpa an, nicht verhindern zu wollen, sondern um Einhaltung von Verfahren zu ringen.

Provisional approval for clearing:
On February 13, 2020, Tesla received approval from the Brandenburg State Environment Agency for the early clearing of mature pine on a timber plantation in the northern industrial area of Freienbrink. However, according to the environmental agency, this work is carried out at Tesla's own risk, since a final approval has not yet been granted. Tesla had announced, among other things, the triple reforestation with quality forest as part of the process. An RBB (Rundfunk Berlin-Brandenburg) report dated February 14, 2020 states that, if the Tesla project in Freienbrink is not approved, the investor must reforest.
Thus, the clearing on the pine plantation began on February 13, 2020 using large equipment such as harvesters.
The nearness of the growing season - March 1st - explains the rush. After that date, the clearing operation will have to postponed to autumn. Until then, any pine trees that have not been felled would hinder any construction work. The project developer Tesla started the process on December 19, 2019.
Complainants failure
One day later, a Bavarian association (VLAB) and the Green League took action against the granting of the early clearing permit by the Brandenburg State Environment Agency. Their complaints, which sought the prohibition of early clearing, were dismissed on February 14, 2020 by the administrative court in Frankfurt/Oder.
Provisional decision of the OVG Berlin-Brandenburg
The Green League then took its case to the Higher Administrative Court of Berlin-Brandenburg (OVG). On February 15, 2020, this instance provisionally ruled that the clearing should be stopped. However, the matter still had to be examined and the complaint decided upon (file number OVG 11 S 8.20).
The lawyer Dirk Teßmer from Frankfurt am Main represents the Green League. He claims that the early clearing does not meet the legal requirements for approval. There was still no opinion from the specialist authorities and environmental associations and consideration of objections from the interpretation phase of the planning documents, which was just completed.
